Terms and Conditions – Privacy Policy
Payments:
The Client agrees to follow the established payment process and comply with the deadlines specified by the Artist.
The Client must pay at least 50% of the total budget in advance to start the design process.
The final art of the book will only be delivered to the Client once the final payment has been made. If the Client paid in two parts, the files will be delivered via email or wetransfer.
The initial payment will be made before the work begins, this payment will be agreed upon for either half or full payment.
Failure to pay as agreed will result in the Designer retaining the rights to the work until payment is completed, and if the second payment is not made, the estimate will not be refunded nor will any files, the design may be used as premade to obtain lost profits.
Refunds:
If the design has not been started, the Client is entitled to receive a refund of 25% of the first payment made for management reasons.
Designs with an advance will not be refunded.
If the Client disappears, or the project is stopped without prior negotiation, the Client will lose their right to a refund and their place to receive the service after three weeks without a response. This means that the project will not be able to continue after this period. In case of justification for the pause of the project, the Client must contact the Designer via email tylerevelynrood@gmail.com or through the previously agreed communication channel.
In the event of cancellation by the Client before work has commenced, a partial refund may be made subject to the discretion of the Artist.
Once the final file or digital product has been delivered, returns or refund requests are not accepted, since there is no way to "return" a digital file.
If the client cancels the project before any design phase has begun, 80% of the amount paid will be refunded, with a 20% retained for administrative fees and scheduling reservations.
Force majeure on the part of the designer: If due to force majeure Tylerevelynrood is unable to continue with the project, 100% of the payment made will be refunded.
If the client requests changes outside the original scope of the project, these will be quoted and billed separately. (Refusal to pay additional adjustments does not constitute grounds for requesting a refund.)
The client is responsible for providing clear and complete information for the design process (references, concepts, text, colors, etc.).
Errors resulting from incomplete or confusing information provided by the client will not be grounds for a refund.
Changes and Revisions:
The Client has the right to two initial revisions after receiving the first draft of the cover or cover, they will always be asked before starting the color part if the design is approved.
Once the limit of changes mentioned above has been exceeded, an additional charge will be applied for each extra change made, the value will depend on the changes that are desired to be made by agreeing in the chat between the client and the designer.
If a complete change is requested during the color phase, the project will be budgeted again, including the corresponding additional charges.
Failure to respond or approve the customer within the agreed deadlines may affect the delivery schedule or cancel it after 3 weeks without a response from the customer. (If you present a justification of absence, your order will not be cancelled.)
All changes and revisions must be communicated clearly and in detail by the Client to the designer, and the designer agrees to make the requested changes in accordance with the instructions provided by the Client. (Once agreed and spoken between both parties)
All alternative revisions or changes outside the delivery will be considered as extra charges (if there is an error made by the designer this extra charge will not be considered, and the error will be fixed.) Each additional revision will be subject to the terms and rates agreed between both sides.
The Designer will correct any errors or problems that are attributable to her work at no additional cost to the Client making the Client responsible for reviewing and approving each stage of the design process any errors or misunderstandings that arise due to the Client's lack of review It will not be the responsibility of the Designer.
Attributions and Copyright:
The Designer will retain the copyright of all works created during the cover design process; Ideas, sketches, recreations, test covers… etc.
The image/design provided by the Designer cannot be used to train an AI in any way, nor can it be used for tracing of any kind.
The image provided by the Designer cannot be modified without her consent. If you wish to make a subsequent modification, please contact the Designer through the means of communication agreed between both parties.
The Client agrees to give attribution to the Designer when publishing the design on social media and in the copyright details of the published designs, under the name Tyler Evelyn Rood (@tylerevelynrood) even if the design will be printed and laid out at another publishing house.
It is prohibited to recreate the style or cover on projects in which I am not involved. The design provided, including but not limited to illustrations, graphics, visual concepts, and any other visual representation, is the exclusive property of Tyler Evelyn Rood. Adaptation, reproduction, tracing, redesign, copying or any other use of the design without the prior written consent of the designer is strictly prohibited. Any violation of this clause will be considered a violation of intellectual property rights and will be subject to appropriate legal action, including, but not limited to claims for damages or exposure on social networks.
If the design is accepted for redesign or adaptation, thus creating other creative projects that are inspired by the original design, royalties must be paid, which will be stated by the designer.
Once full payment has been made, the Client will obtain the rights of use only for what was requested, any extension of this must be notified and an external use fee must be paid for its reproduction not contemplated agreed between the client and the designer of the cover designed exclusively for the project.
The Designer reserves the right to use the design in her portfolio, on social media, or other media for promotional and commercial purposes.
Any modifications made to the design after final delivery will require the Designer's approval and may be subject to additional fees if improvement is needed. The final design cannot be modified unless these are necessary for publication in print.
The transfer of all or part of the copyright to third parties will require a written agreement between the Client and the Designer, adding the amount of royalties to be able to access the use and enjoyment of the cover/design on another site.
No editable articles will be sent unless they have been purchased at an extra cost.
Any unauthorized use of the work by the Client or third parties will be considered a violation of copyright and will be subject to legal action. If the author lives in a country where the laws of this contract are not applicable, I can make the case visible on social networks.
All art that goes inside the book must be signed by the artist @TylerEvelynrood, whether it is a work created directly for the book or an external work commissioned to be added within it.
The image provided by the Designer may not be used as a reference for other commercial purposes in which he/she is not involved. This includes tracings of the sketch or final work, use of fonts and applications, etc.
The continuation of a concept with another designer based on the first designs, sketches, messages between the designer and the client is explicitly prohibited, any idea discussed between both is non-transferable unless clause 6 is met.
Acceptance of Terms and Conditions:
By hiring the services of the Designer, the Client accepts and agrees to comply with these terms and conditions in their entirety.
These terms and conditions are designed to clearly establish the copyright and attribution associated with the designed cover, ensuring mutual understanding and respect for the rights of both parties.
By contracting the services of the Designer, the client declares that he/she has read, understood and accepted these Terms and Conditions in their entirety before contracting her services and subject values.
Remember that these terms and conditions are subject to change and modifications, you will always be notified if there is any change.
The client and the designer will respect the delivery times of both, if the delivery times are suddenly postponed, the designer can ask for more time.
The fonts purchased are the authorship of the designer, extending the license to the author (Unless the author purchases it externally and personally for commercial use) If the typeface is used for external designs with an extended license from the designer to the author, the designer is not responsible for any legal accusations that this may entail.

PHYSICAL COPY AND SHIPPING – Tyler Evelyn Rood commits and agrees to send a finished physical copy of the published book to Tyler Evelyn Rood once it is printed. Tyler Evelyn Rood shall be solely responsible for covering all shipping costs, delivery fees, and any associated duties required to deliver the physical copy to the designer's designated address.
AI Statements:
Each project is developed using manual processes and traditional or digital techniques controlled by the designer, ensuring authenticity and originality.
It is expressly stated that no part of the creative process includes AI programs, platforms, or algorithms to generate ideas, sketches, images, text, or other visual elements.
The client receives a guarantee that the works are original and created exclusively for their commission, avoiding potential conflicts related to copyright or AI-generated content.
The author is prohibited from submitting the completed design, artwork, sketches, or creative process to artificial intelligence. The designer may withdraw from the process without refunding the payment, regardless of the stage of the creative process. The designer will not retain the design, as it has been submitted to artificial intelligence.
Transparency and Trust: Tylerevelynrood is committed to maintaining a policy of transparency, always informing its clients about the techniques and tools used in the development of each design. Sending process or videos.
